BOOKING TERMS AND CONDITIONS

Thank you for choosing to book your holiday with Ace Echuca Family Holiday Accommodation. Please ensure you read the information below to ensure your stay is enjoyable.

​

All bookings are accepted on the basis that you have read, understood and agreed to the following terms and conditions and house rules.  ACE ECHUCA takes NO responsibility for guests not reading the information sent and for not being aware of declared exclusions or important information.

  • Bookings made via 3rd party websites with held payments (AirBnB, Stayz, VRBO) will incur the cancellation policy of the website booked, or we will assist with facilitating changes as per terms via those sites.  We will reach out with instructions once your dates are officially declared as restricted.

​

Once your booking is made you will receive an invoice from us with the details on how to process your payment. Your booking is not confirmed until payment is received by us.  Receipt of your payment confirms that you have read and agreed to our Terms and Conditions herein.


Definitions
Booking means the period for which you have paid to stay at the Property.

Property means the home you have booked as per your confirmation notice and all its fixtures, fittings and equipment.

Management means the owners and managers of the Property.

Deposit means the non refundable deposit you pay to secure the booking – this is advised in writing to you.

Guests means the persons who stay overnight in the Property during the Booking.

Visitor means a person a Guest permits to visit the Property during the Booking.

Security Bond means the bond you pay to cover any damages or costs that may occur during your stay.  Providing there are no damages or costs this is refunded after your stay.

Acceptance & Responsibility
The person whose name is on the booking must be staying at the property. This person is responsible for the booking with us and ensuring all guests and visitors are aware of the terms and conditions and house rules.

Identification and/or credit card details will need to be provided at time of booking.  Your credit card details are taken to cover any incidental expenses incurred pertaining to these booking conditions.

​

The guests warrant this is for holiday purposes and indemnifies the Management for any other form of use.

We recommend that all guests have travel insurance for their holiday. Note: variances may be agreed on but only by arrangement with the Owner/Management in writing.

The property is not a ‘party house’ and these activities are strictly prohibited. Prohibited activities are defined as ‘parties, including, for example, bucks nights, hens nights, raves, wedding receptions or similar parties.’ No guests or visitors have permission to enter, remain or engage in any such prohibited activities at the property or engage in anti-social behaviour including ignoring curfews and/or excessive noise and any person purporting to act in contravention of this restriction does so as a trespasser rather than as a guest or permitted visitor at the property. If you misrepresent your booking and/or do not comply with our Terms and Conditions we reserve the right to evict and retain all monies paid including the Security Bond.  Minimum age to hire the property must be 28 years or older.

Disturbance & Antisocial Behaviour
In accordance with local laws and Holiday Rental Industry guidelines disturbance to the neighbours, including excessive noise and anti social behaviour is prohibited and may result in termination of rental and loss of all monies paid.

As per Council and Holiday Rental Industry Guidelines there is a 10.00pm to 8.00am outside noise curfew. We require you to move inside and close the doors. Noise must be kept to a minimum.

If Security is called out to the property you will be charged for the call-out fee and we reserve the right to terminate your booking. All call-outs will be deducted from your security bond.  If your booking is terminated we reserve the right to retain all monies paid including your Security Bond.

Payment
A deposit of 50% of the total booking price (or deposit as advised to you in writing) is required to secure the booking within 2 days of the Booking invoice being sent. Bookings are not confirmed unless and until this deposit is received.

Payment of the booking deposit constitutes the clients acceptance of these Terms and Conditions.

The balance of the booking amount must be received in full 30 - 60 days prior to occupancy depending on the season. If not Management has the right to cancel the booking and attempt to re let it.

Payments of the amount due must be received in Australian dollars net of any bank or other transaction charges.

We accept payment by the following methods: Visa, MasterCard, cash or direct deposit into our bank account.

Credit card payments can be made via eft to our bank or direct to Management by calling ph 0438 375 938.

A credit card surcharge of 3% will be levied to cover transaction costs associated with credit card or paypal payments.  The 3% surcharge is not refundable on cancellation or the bond return.

​

ACE ECHUCA requires the holding of credit card details (if CC details have not been provided prior) as security for damage, excess cleaning costs & extra charges incurred as outlined below. Payment of deposit constitutes agreement that the provided credit card can be used to re-claim costs involved with issues at the booked accommodation -

  • Accommodation is to be left in the condition in which it was found in relation to building, asset, grounds & cleanliness. This includes furniture & fittings being returned their original position.

      Credit card details will be held and charges will be processed relevant to the incident if : ·

  • Building, asset or grounds are damaged and deemed in need of repair or replacement. If guests believe building, asset or grounds to be damaged upon arrival, it is their responsibility to inform management immediately to avoid incurring costs related to this damage.

  • Extra charges may be incurred if moved furniture is not replaced on departure due to the inclusion of extra staff for OH&S reasons. ·

  • Excess cleaning is necessary beyond what would be considered reasonable inclusive of dry cleaning in relation to pet hair, deep cleaning of mattresses & the removal of cigarette smells (all properties are strictly non-smoking).  We allow 4 hours cleaning per stay in the rate paid. 

  • Guests fail to depart by 10am on departure date without prior arrangement of late check-out.

  • It is your responsibility to secure the property and lock all doors and windows and leave the key in the secure Key Box located beside the front door on departure.

Variations & Cancellations

If you cancel your booking within one month of check in, do not show up for your booking or alter your stay you will forfeit your deposit.  The total amount outstanding will be charged to your nominated credit card if not already paid. We will do everything we can to re rent your house for the same period and rate. If a refund is made due to the property being re-let at the same rate for the same number of days then a $100 cancellation fee applies.

If you wish to vary or cancel your booking, please advise us immediately on 0438 375 938 and confirm in writing. The sooner you let us know the better chance we have of rebooking your reservation.

Management is not obliged to accept any variations to the booking if they are adversely affected by the request and will instead treat the variation as a cancellation.

We recommend that all guests have travel insurance for their holiday.

Please do not hesitate to contact us should you have any queries regarding the cancellation policy.

*If you have booked via a 3rd party booking site such as AirBnB, Stayz.com, Booking.com, their cancellation policy will override this.  Please ensure you are familiar with the policy you have agreed to at the time of booking.

All cancellations must be received in writing via email to be applied.

Refundable Security Bond
The Security Bond payment is required at the same time as the outstanding balance of your booking. After your departure we will contact you to request your account details.  Once the property has been inspected and deemed left in a similar state to your arrival the refund will be made.  The payment will be credited to your designated payment method and we agree to ensure this occurs within 7 working days of your departure/receipt of banking details.  NB in practice this is normally done within a couple of days of your departure.

Any damage, loss or expense incurred by Management as a result of your breach of these Terms & Conditions will be charged against the security bond and if necessary the credit card supplied on arrival.  Examples of this include but are not limited to any breakage, damage or excess cleaning requirements, extra guests beyond those declared, misrepresentation of your stay and security call outs. If a deduction is to be made due to any of the above an administration fee of between $50 and $100 will also be charged to cover arranging for replacement or repair of each item/issue.

Unavailability & Unforeseen Circumstances
The owners will make every effort to ensure the property is available as booked. However, the owners reserve the right to make alterations to the booking due to unforeseen circumstances and/or allow tradesmen to have access to the property to facilitate any repairs if necessary.   If the Property becomes unavailable for your occupancy due to unforeseen circumstances then Management will inform you immediately and any monies paid will be refunded in full.

We cannot be held responsible for any unforeseen breakdowns of appliances etc.  Ace Echuca maintains our property to the highest standard however at times unforeseen issues can occur. All repairs will be carried out or replacements purchased at the earliest convenience. Every action will be taken by our staff to minimise inconvenience caused; however there is no obligation from Ace Echuca to issue any partial refunds or discounts if the issue was unavoidable.  WiFi is provided as a convenience only and are not integral to the license to use the property. No refund of payments shall be given for outages, speed, access problems, lack of knowledge of use, or personal preferences with regard to services”. The WiFi needs a password to access it.”

ACE ECHUCA takes no responsibility for personal property left at the accommodation during or on departure of guest’s stay, however we will endeavour to return items found left on premises.  If items are left at a property, we require the guest to please:

Contact ACE ECHUCA immediately with details & location of the item.

Mail a stamped, self addressed envelope suitable for your item to 16 Tyler Street Echuca 3564.

Items are held for a maximum of 2 weeks and will then be donated to charity.

ACE ECHUCA takes no responsibility for bookings taken via phone or internet without prior inspection of the property.

Guests must be aware that ACE ECHUCA is in a country setting and there is always a risk of bugs, spiders and snakes being within the vicinity of the property. Although all care is taken to avoid their entry to the property, and prompt removal will be undertaken, standard cancellation policies will still apply should the guests simply disapprove of bugs & animals.

Upon payment of deposit and acceptance of terms & conditions, guests agree to respect the privacy and right to quiet of neighbours and other guests. Guests agree to behave in an orderly conduct and take full responsibility for their actions, behaviour and any incidents which may occur during their stay. ACE ECHUCA takes no responsibility for injury or incident caused by irresponsible or disorderly behaviour or conduct.

All information and photos included in this website were accurate at time of creation. Although care is taken, ACE ECHUCA takes no responsibility for changes to property, pricing or facility which may have occurred. All bookings are made in good faith and ACE ECHUCA takes no responsibility for any issues which may arise directly between guests and property owners.

In the event of a natural disaster interrupting your ability to remain safely at your accommodation or arrive at your destination, ACE ECHUCA will issue full refunds minus any non-refundable booking fee.  Refunds will not be issued if your property resides in an area deemed safe and if your travelling path is unrestricted.

  • In an event where authorities are recommending visitors leave (such as a 'WATCH & ACT') or do not travel to the area, ACE ECHUCA agrees to fully refund days that authorities recommend distance.  It is anticipated that if the following day offers downgraded warnings or restrictions, the booking will continue as normal.  Alternatively, if guest's do not wish to travel the following day on their own account, ACE ECHUCA agrees to offer a transfer of dates for the same length stay at a later date.

  • In the event of a declared 'CODE RED' day impeding travel to the area, ACE ECHUCA agrees to refund payment made for the day that travel is not recommended.  It is anticipated that if the following day offers downgraded warnings or restrictions, the booking will continue as normal.  Alternatively, if guest's do not wish to travel the following day on their own account, ACE ECHUCA agrees to offer a transfer of dates for the same length stay at a later date.

  • In the event of a declared 'CODE RED' day while guests are in attendance, ACE ECHUCA agrees to offer a refund of the remaining stay if a guest feels they do not wish to stay in the region. 

  • ACE ECHUCA takes no responsibility for the safety & wellbeing of guests while in residence at the time of any natural disasters or events.  ACE ECHUCA will however endeavour to provide as much communication and local information to guests as possible.  It is 100% the guest's responsibility to make all decisions & choices regarding their safety and plans.

  • ACE ECHUCA will not offer any refunds or transfers for any other inconvenient weather - such as rain, flood, heat without fire warnings, wind etc.

  • In the event of a PANDEMIC or social health situation, ACE ECHUCA will follow all government advice and will work with guests to create an outcome suitable for all parties.  ACE ECHUCA will offer credits at the same property in off-peak periods to anyone falling outside government warning restriction dates. Guests impacted should contact ACE ECHUCA directly as procedures will change daily.

 

 

Check in & Departure
Check-in time is from 3.00pm on the arrival date and check out time is not later than 10.00am on departure date to allow time for the property to be prepared. Variance to these times is subject to prior arrangement and availability.  You must notify Management of expected arrival time and a mobile contact number at least 7 days before arrival.  You will be provided with a key box code one day prior to your arrival.   An electronic door code is also provided for the main door.  There is no access to the property other than the front door.  All side gates and garage doors are locked with security camera surveillance.  
Failure to depart at the agreed time may result in an additional charge of $50 per half hour.

​

Linen & Towels
We supply hotel quality linen, pillows, blankets and two bath towels per guest which must be left at the property on departure. Pool towels are not supplied so please bring your own.  Port-a-cot linen is not provided.  

​

Number of guests must not exceed the number stated on the Invoice Notice or subsequently agreed in writing/email. Fees will apply for excess guests not agreed with the owners in advance.   Any misrepresentation regarding guests or intention of your stay may result in eviction and loss of monies paid.  ACE ECHUCA reserves the right to gain immediate possession of the property with no refund.

Security Camera Surveillance is located at the front door covering the front patio, front yard and car parking areas.  It is recording 24/7.  A security camera is also located in the backyard covering the deck and pool area.  It is covered to protect your privacy when guests are present.  There is no sound recording.  Security alarm sensors are also fitted throughout the house and will be switched off upon guest arrival.

ACE ECHUCA has a pool on-site and is located in close proximity to rivers.   Although the pool has approved fencing there are always risks involved around water for children & adults. The local rivers are not fenced and pose great risks to children when unattended. ACE ECHUCA and owners take NO RESPONSIBILITY for any incidents occurring in or around the water. We are immensely concerned for children's safety, please use caution around water and never leave children unattended.   The onus of responsibility of guests around water lies 100% on the person making the booking.  


Pets are prohibited.  Evidence of an animal being at the property will result in full loss of bond.  We are advertised as a pet free property.  Pets are not allowed under any circumstances.  ACE ECHUCA reserves the right to gain immediate possession of the property with no refund.

Smoking is not permitted inside the house at any time.

​

Parking of cars must be in accordance with Council regulations.  Do not park on the nature strip.

​

Additional caravans, motor vehicles, motorcycles and the erection of tents are strictly prohibited.

​

Caution must be taken on all tile areas, wooden floors and outdoor areas as they may be slippery when wet.

​

On departure the property should be vacated on time and secured. All rubbish put in the appropriate recycle (yellow) and waste (red) council rubbish bins provided, (and overflow bin - yellow), crockery and cutlery washed and packed away. All furniture and furnishings must be left in the position they were in when you arrived. The Property must be left in a clean and tidy condition.

Standard exit cleaning of 4 hours is included in your tariff however any additional cleaning a rate of $50 per half hour will be charged to your bond or credit card.  A separate charge of $50 if the BBQ or oven are not left in a clean state on your departure. The house will be cleaned for your arrival and then cleaned on your departure. 

​

Damage, breakages, theft/loss and security is the tenants’ responsibility during their stay. You must lock all doors and windows when you leave the property and it must be secured at night. You must notify us immediately of any damages, breakages or theft. Management may deduct from your security deposit the amount required to repair or replace any items (at Management’s discretion). The Owners/Management takes no responsibility for the tenant’s personal property during your stay.

Responsible behaviour is expected by all guests and visitors to the property including compliance with our Disturbance and Antisocial Behaviour Terms and Conditions.  Drugs or illegal activities are strictly prohibited on the premises and alcohol should be consumed in a responsible manner.

Maintenance issues need to be advised to Management at the earliest opportunity during business hours so Management can rectify the situation quickly and efficiently. You must allow repair/service technicians access to the property during reasonable hours. Failure to follow this procedure may hinder the ability of Management to rectify the issue.  Emergency Only issues can be advised out of business hours.

Variations to these conditions may only be made by prior arrangements with the Owner/Management in writing.  The Owner/Management reserves the right to terminate the rental at any time if any of the above conditions are not adhered to.
